Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the OpenMatchDay tournament management platform ("Service") operated by POISE AB, a Swedish company (VAT ID: SE556773092301) ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

3.1 Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at hello@openmatchday.com if you suspect unauthorized access.

3.3 Account Information

You must provide accurate and complete information when creating an account and keep it up to date.

4. Subscriptions and Payment

4.1 Plans

The Service is offered through paid subscription plans. Each plan defines limits on the number of active tournaments, teams per tournament, and available features. Plan details and pricing are available on our pricing page.

4.2 Trials

We may offer free trials at our discretion. Trials provide temporary access to the Service and expire automatically. No payment information is required to start a trial.

4.3 Payment

Subscriptions are prepaid. Prices are listed in EUR unless otherwise agreed. Payment is due at the beginning of each billing period.

4.4 Refunds

Subscription fees are non-refundable except where required by applicable law. If you are dissatisfied with the Service, you may cancel your subscription and it will remain active until the end of the current billing period.

6. Intellectual Property

6.1 Our Property

The Service, including all software, design, text, graphics, and trademarks, is owned by POISE AB and protected by applicable intellectual property laws. Nothing in these Terms grants you ownership rights to any part of the Service.

6.2 Your Data

You retain ownership of all data you enter into the Service (tournament data, team names, player names, logos, etc.). By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service.

7. Data and Backups

7.1 Data Storage

Your data is stored on EU-based servers. We implement appropriate security measures as described in our Privacy Policy.

7.2 Data Retention

Active tournaments are retained as long as your subscription is active. Completed tournaments are retained for 60 days after completion and then automatically deleted. Draft tournaments that are not activated are deleted after 24 hours.

7.3 Backups

We maintain regular backups of the Service as part of standard operations. However, we do not guarantee the availability of backups for individual data recovery. You are encouraged to export your data regularly.

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

9.1 Termination by You

You may cancel your subscription at any time. Your access will continue until the end of the current billing period. After cancellation, you may request a data export within 30 days.

9.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or if we discontinue the Service. We will provide at least 30 days' notice for discontinuation, except in cases of Terms violations.

9.3 Effect of Termination

Upon termination, your right to use the Service ceases. We will retain your data for 30 days to allow for export, after which it will be permanently deleted.

You agree to indemnify and hold harmless POISE AB from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law and Disputes

These Terms are governed by the laws of Sweden. Any disputes arising from or in connection with these Terms shall be settled by the courts of Gothenburg, Sweden, as the court of first instance.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
